Preparing a Will is the only way to ensure that your assets pass on to the people you want to receive them. If a person dies without a Will (intestate), state law determines who gets your assets. When you prepare a Will, you also get to affirmatively designate who will administer your estate. In the event that assets could potentially pass to a minor, a Will can be tailored to provide that a minor trust “springs up” upon your death and the trustee you name can protect the assets for the benefit of minor beneficiary who takes under the Will until such time as you wish them to assume control of the assets.
